Legal regulation of the issue of independence of judges should be carried out exclusively on the basis of the provisions of the Constitution and laws of Ukraine, while taking into account the international legal obligations of Ukraine in this area. The scope of guarantees for the independence of judges should be determined by the tasks and functions of the judiciary, while their level should not be reduced. Guarantees of ensuring the right of citizens to work are defined in Art. 4 of the Law of Ukraine “On Employment”
The state guarantees to the able-bodied population of working age in Ukraine:
voluntary work, choice or change of profession and type of activity; protection against unjustified refusal to hire and illegal dismissal, as well as assistance in keeping a job; free assistance in the selection of suitable work and employment in accordance with the vocation, abilities. Vocational training, education, taking into account social needs, by all available means, including vocational guidance and retraining; compensation of material costs in connection with the referral to work in another area; payment of severance pay to employees who have lost their permanent job at enterprises, institutions and organizations, in cases and under the conditions provided by applicable law; free training of unemployed in new professions, retraining in educational institutions or in the system of the state employment service with the payment of scholarships; payment to the unemployed in the prescribed manner of unemployment benefits, material unemployment benefits to family members who are dependent on them, and other types of benefits; inclusion of the period of retraining and training of new professions, participation in payments for public works, receiving unemployment benefits and material unemployment benefits in the total length of service; providing work in the specialty for a period of at least three years to young specialists – graduates of state educational institutions of the state, previously declared by enterprises, institutions, organizations.
Public authorities ensure the publication of statistical data and information materials on the supply and demand for labor, employment opportunities, vocational training and retraining, vocational guidance and social and labor rehabilitation.
To implement the employment policy and provide guarantees to citizens in all territories of Ukraine, employment services have been established, the activities of which are carried out under the leadership of the Ministry of Labor and Social Policy of Ukraine and local state administrations. Services related to employment are provided free of charge by the state employment services.
Citizens of Ukraine have the right to employment and choice of place of work by applying to an enterprise, individual farm or other employer, including an individual, directly or to the state employment service for assistance in finding a job. Unemployed citizens who want to work, as well as employed citizens who want to change their place of work, get a part-time job or in their free time, can apply to the state employment service for assistance.
All unemployed citizens who apply to the state employment service for assistance in employment are subject to registration, including pensioners, the disabled and young people who have graduated from secondary schools, vocational schools. During registration, each person independently or with the use of an automated system with the help of an employee of the state employment service fills out a personal registration card of a citizen looking for work, and a personal signature confirms the authenticity of the data entered and reads “Your rights – your responsibilities”. “.
The form of this personal registration card is approved by the Ministry of Labor and Social Policy of Ukraine. Employed citizens who work full-time or part-time or self-employed. During the reception of such citizens, the employee of the state employment service consults on these issues and makes appropriate entries in the consultation card. Registration and registration of citizens who apply for employment assistance is carried out by the state employment service at the place of permanent residence, subject to the presentation of a passport and employment record book, and if necessary – a military card, education document or documents that replace them.
Foreign citizens and stateless persons are registered and registered only in the presence of a permanent residence permit. If a citizen does not have a passport, it can be replaced by a certificate issued by the housing and maintenance office or the local body of internal affairs indicating the place of permanent residence of the person.
Citizens under the age of 16 must present a birth certificate and a certificate from the housing office or local government indicating the place of residence.
